1. Registration & Licensing

License Types & Eligibility

Chicago has a tiered licensing system managed by the Department of Business Affairs and Consumer Protection (BACP). You must choose one:

  • Shared Housing Unit License: For properties with up to 6 sleeping rooms. Can be owner-occupied or not. This is the most common license type for individual hosts.
  • Vacation Rental License: For larger multi-unit operations or professional management companies. Requires more extensive compliance.

Unlike Los Angeles, Chicago does not require primary residence status for the Vacation Rental license. However, the Shared Housing license type has flexibility — you can own it without living there, but if you do offer a shared housing type license, the owner must have an interest in the property.

How to Apply (Step by Step)

  1. Gather your documents: Government-issued photo ID, proof of ownership or authorization to rent the property (deed, lease with landlord permission, or notarized letter), property address, and planned listing platform(s).
  2. Apply online: Submit your application at chicago.gov/city/en/depts/bacp.html. You can also apply by mail or in person at BACP offices.
  3. Pay the license fee: $125 annually. Payment is made at the time of application.
  4. Receive your license number: Processing typically takes 2-4 weeks. Your unique license number will be issued via email.
  5. Register with platforms: Before listing on Airbnb, VRBO, or other platforms, you must enter your Chicago license number. Platforms verify this against the City's database.
  6. Display your license number: Your license number must appear prominently on ALL listings, property descriptions, and advertisements.

Renewal & Deadlines

License renewal is due July 1st each year. Applications for renewal should be submitted 30 days in advance. Late renewals may result in fines or delisting.

What Airbnb & VRBO Handle

Major platforms like Airbnb and VRBO have collection agreements with Chicago and Cook County. They automatically collect and remit:

  • Hotel Accommodation Tax (4.5%)
  • Applicable Shared Housing Surcharge
  • Cook County room tax

You do NOT need to file these portions separately if you list on these platforms.

What You Must File Personally

You are responsible for:

  • Illinois State Hotel Tax: File quarterly through MyTax Illinois portal at mytax.illinois.gov. Due dates are the last day of the month following each quarter.
  • Chicago Home Rule Tax: Usually collected by platforms, but verify with your host dashboard.
  • Direct bookings: If you accept off-platform bookings, you must collect and remit all applicable taxes yourself.

Record Keeping

Maintain detailed records of all bookings, nightly rates, cleaning fees, and taxes collected for a minimum of 3 years. The City can audit these records at any time.

3. Operating Restrictions

No Night Limit (For Licensed Properties)

Unlike many cities, Chicago does not cap the number of nights you can rent — as long as you maintain an active license. You can rent year-round.

Occupancy & Unit Rules

  • Maximum 6 sleeping rooms per unit: You cannot rent out more than 6 bedrooms in a single property under a Shared Housing license.
  • Cannot exceed posted occupancy limits: Abide by all fire code and building code occupancy restrictions for your property type.
  • One guest certificate per listing: Each listing must have its own license or be clearly registered under your primary license.

Property Eligibility Restrictions

You cannot operate an STR if:

  • The building has received housing subsidies (Section 8, public housing, or other subsidy programs) within the past 5 years
  • The property is located in an aldermanic ward that has voted to restrict or opt-out of short-term rentals — Chicago allows wards to impose local restrictions, so verify with your alderman's office
  • The property is part of a condo association that has prohibited short-term rentals in its bylaws

Before investing time in registration, contact your alderman's office to confirm your ward allows short-term rentals. Some aldermen have passed local restrictions that supersede the City license.

4. Safety Requirements

Chicago enforces strict building and fire safety standards for all STRs. Your property must meet the following requirements:

Smoke & Carbon Monoxide Detection

  • Smoke detectors: Required in every sleeping room, in hallways, and on every floor of the building. Must be working and battery-backed or hardwired.
  • Carbon monoxide detectors: Required on every floor if the property has gas appliances, a furnace, or an attached garage.

Fire Safety Equipment

  • Fire extinguisher: At least one extinguisher must be accessible to guests (typically in the kitchen).
  • Emergency exit routes: Ensure windows and doors are not blocked, and exits are clearly marked.

Building Code Compliance

  • The property must comply with all Chicago Building Code requirements for residential use.
  • BACP may conduct inspections before license approval or during compliance audits.
  • If violations are found, they must be corrected before or shortly after license issuance.

Emergency Contact & Posting

  • Post emergency contact info visibly: Your name and phone number (or on-call manager) must be displayed in a prominent location so guests can reach you in an emergency.
  • Provide guest information sheet: Include the location of fire extinguishers, smoke/CO detectors, emergency exits, and local emergency numbers.

5. Insurance Requirements

Chicago requires all STR hosts to maintain $1,000,000 in liability insurance. Standard homeowners policies typically exclude short-term rental activity, so you must obtain separate coverage.

Proof of Insurance

  • You must provide proof of $1M liability insurance when submitting your initial license application.
  • Proof must be resubmitted at every annual renewal (July 1st deadline).
  • Keep a copy of your insurance certificate easily accessible for inspections or compliance verification.

Platform Coverage Does Not Substitute

Airbnb Host Protection and VRBO liability coverage are considered secondary insurance. They do not satisfy Chicago's primary insurance requirement. You must maintain your own independent liability policy.

6. Fines & Penalties

Chicago enforces STR compliance with substantial daily fines. Violations can accumulate quickly:

Fines are assessed per day of violation. A single unlicensed listing discovered in January that continues through March could result in 90 days × $1,500 = $135,000 in fines.

License Revocation & Delisting

Repeat violations or serious infractions (false application info, safety violations) can result in license revocation. Once revoked, you cannot re-apply for 12 months. BACP notifies platforms, and your listings are automatically removed.

7. What Platforms Handle vs What You Handle

Platforms (Airbnb, VRBO) Handle:

  • Verify your Chicago license number against BACP's database before listing approval
  • Collect and remit Hotel Accommodation Tax (4.5%), Shared Housing Surcharge, and Cook County room tax
  • Remove or suspend listings if your license expires or is revoked
  • Report listing and transaction data to the City for compliance monitoring
  • Provide secondary host protection insurance
